If I hire a tax attorney will the IRS think I’m guilty of something?

No. Taxpayers often subject themselves to the myth that if they hire a tax attorney, the IRS will think that they are guilty of something or get mad at them for not facing their problems alone. This thinking could not be further from the truth. IRS auditors and collectors prefer dealing with an experienced tax professional because it often makes their jobs easier. A good tax professional knows what the IRS wants and the problem becomes one that is between two professionals to resolve rather than an emotional situation.

I am located of the Metro DC area can you still represent me?

Yes.  We can represent client’s with IRS issues in all states.

The IRS seems very nice on the phone. Should I just deal with him myself?

No. Most IRS employees are polite and professional. This does not mean they are your friends. Their job is to collect taxes. They will collect them from you along with penalties and interest, unless you have a trained professional looking after your interests.

Can't I just have a CPA, tax preparer or enrolled agent help me instead of a tax attorney?

Only with an Attorney do you have the important attorney-client privilege which makes an attorney legally exempt from being forced to testify against you should the IRS prosecute you criminally. Additionally, most complex situations cannot be handled by CPA’s and/or Enrolled Agents.  Finally, only attorney’s can give you all your legal options.

Does the IRS treat different kinds of taxes differently?

Yes, the IRS deals severely with businesses who have failed to pay their payroll taxes.  Nevertheless, with proper representation, and in the appropriate circumstances, there are legal options.

Could I go to jail or prison for not filing my taxes?

Yes. The IRS may seek to impose a criminal offense for failure to file tax returns as required.

The IRS wants me to give them more time by extending the statute of limitations.  Should I agree to do so?

This is a difficult question. The answer will vary depending upon the exact circumstances.  Please note that you have no legal obligation to do so, and in many cases it will not be to your advantage.
